CTA rejects FMC Switzerland appeal on VAT refund claim

The Court of Tax Appeals (CTA) En Banc has denied a petition by FMC Switzerland II GMBH, Manila Regional Operating Headquarters (ROHQ), affirming the dismissal of its claim for a P10.5-million value-added tax (VAT) refund, according to BusinessWorld.

The CTA ruled that the company failed to timely elevate the case to the tax court, which was the basis for the denial.

The decision upholds an earlier ruling that dismissed the refund claim due to procedural lapses.
